Hi,

I'm wondering if anyone can shed some light on some worry I have;

I am 18 and have an ILR visa for the last 10 years living in the UK but have been abroad to my home country for the last 18 months and due to return to the UK shortly.

My ILR visa is in an expired passport and since then I've changed my surname in my home country and my current passport shows the new surname.

I dont have a BRP and had planned to apply on return but am worried I may have problems entering now due to the name change not being reported sooner as my surname was changed around 3 years ago but my parents never applied for a BRP for me or reported the change. My parents think it will be fine as I've left + entered once before since the name change during a holiday but I've been reading online I could be fined £1000 or denied entry?

Has anyone experience of this or what would happen? I have the certificate of name change from my country and a translated copy, would bringing current and expired passport along with the certificate allow me re-entry as long as I've not been out more than 2 years?

Thank you for any help, I've been stressed and struggling to find an answer other than to apply for BRP which I cant do while outside the country and cant afford the fine or to apply for a new visa for one entry.

ILR is a status granted to individuals, so a name change has no effect on this status. ILR sticker in an expired passport can be used for entry to the UK. You may face difficulty getting on a plane due to name changes but the UK border should be ok with it (you may face delays at the border). You cannot apply for BRP outside the UK so there is no fine. Fine is applied when you arrive here and do not get a BRP.

Thank you Zimba for your reply, that puts my mind at ease to know. I'm planning on contacting the airline directly when Im booking to let them know of the name issue to find out what I need to bring to satisfy them, I hope the certificate of name change along with both passports and birth cert will be good enough. I'll apply for my BRP as soon as I'm back in the UK.
