*HELP* Question about visa validity

Post by anony92 » Wed Dec 08, 2021 5:10 pm

Hello,

The situation is a bit confusing but I will try my best to explain:

I am in the UK on a Tier 2 visa, working in the NHS. My initial Tier 2 visa lasted from Aug 2020 to Aug 2021, but my contract started in Dec 2020 (I came to the UK a few months later than my visa start date due to COVID delays). My hospital said it's not an issue, they would extend my visa in 2021 near its end date. I received a free visa extension, and now have a BRP expiring in Aug 2022.

However, my 1-year contract expired a few weeks ago, and I was told my employer would cancel my visa. However, I still have not heard anything from them or Home Office. I have looked everywhere online and it simply says to check your visa sticker or BRP — which just says expiry in Aug 2022. I understand Home Office doesn't remind people their visas are expiring but surely my employer or UKVI would send some sort of notification here?

I'm just a bit confused — am I overstaying in the UK, despite my BRP showing an Aug 2022 expiry date? If anyone could shed light on this, it'd be very much appreciated. Thank you. Apologies for any confusion.

Visa curtailment/cancellation is only done by UKVI after and employer informs hem, which they have to do within 10 days of your last date of work.

These letters form UKVI can take a couple of months to get sent out. The curtailment period starts from the date of the letter.

Note that you cannot do any work now if you are no longer working for your sponsor.

Thank you for that, I understand and it's very helpful :)
I am not able to leave the UK immediately as I have a few things to clear up here (finding a tenant to take over my place, requesting of certificates, notarizing documents for my registration back home).

Does the UKVI allow a grace period or does the person have to leave IMMEDIATELY as soon the UKVI informs them their visa is cancelled? Some say the UKVI gives you 60 days to leave, some say 28. It's all conflicting.

Thanks again.

Note also that you can try and find another job with a different skilled worker sponsor while you have valid permission or before the end of the curtailment period whichever is sooner.

No. You can only do supplementary employment if you are still employed by your sponsored full time. You also cannot work full time for any another employer unless they sponsor you for a new Skilled Worker visa.

The 1 year free extension you received still states your CoS which is for your sponsor you have now left.

If you are renting, look to see if your contract has a break clause. If not, you can try to negotiate out of your contract.

If it is your your own property you want to let and you are in England, these are some of the laws you must comply with-

https://www.gov.uk/government/publicati ... how-to-let

Plus the landlord mandatory electical safety check that became law this year
https://www.gov.uk/government/publicati ... uthorities

Ask your mortgage lender for permission to let.

HMRC - Overseas landlords (although you still must provide the tenent with an address in England or Wales, where they can serve a court notice on you: see the first link).
https://www.gov.uk/tax-uk-income-live-abroad/rent
and for the tenant who pays the rent to the landlord overseas and not a letting agent
