UK Spouse Visa category A income requirement and timeline

Post by qtnvegh » Thu Dec 09, 2021 6:51 pm

Hi everyone!

I'm currently gathering documents for my wife's spouse visa.
I'm an EU national living in the UK under pre-settled status, and I've been employed since the fifth of July.
We've married on the 25th of October of this year and she is not from the EEA, which means we cannot apply for the EUSS family permit (unless I'm mistaken), so we'll be going through with the spouse visa category A.

I've currently received these payslips :

- 20th of July : £1,588.92 take-home / £2,442.92 gross
- 19th of August : £1,810.07 / £2,804.83 gross
- 30th of September : £1,810.07 / £2,804.83 gross
- 31st of October : £1,810.07 / £2,804.83 gross
- 30th of November : £1,810.07 / £2,804.83 gross

I'm set to receive the sixth payslip on the 17th of December (hopefully), which should be the same.

My question is : is that enough to enter under category A?

From what I understand, the income requirements are calculated under an annualised amount, where the lowest of the gross salaries is multiplied by 12.
In this case, this would give £2442.92 x 12 = 29315.52

Is that correct? Or do you have to be earning £18,600 gross pay in six months altogether?

Also, I'll be receiving the employer letter, and a letter of authentication of the payslips on the 17th as well. That means they'll be made before my sixth months of employments in the fifth of January. Should I wait for the 5th of January or after to apply? Or even, receive these letters?

Last thing : I receive all my salaries through Monzo. Do the statements have to be printed by Monzo, with a stamp on every page and a letter of authentication? I remember reading somewhere they don't require that anymore due to Covid, but I just want to be sure.

Thank you so much everyone, this process is oh so stressing and sometimes confusing, I hope it ends soon with a success! :D

Your pay meets the Category A income requirement.

BTW I expect your July 2021 pay was less than in the following months because you only started work on the 5th of that month.

Yes because you have to be in salaried employment for at least 6 months at the time of application

Not "and" but "either or". From the immigration rules:

Bank statements must be:
(1) on official bank stationery; or
(2) ]electronic bank statements which are either accompanied by a letter from the bank on its headed stationery confirming that the documents are authentic or which bear the official stamp of the issuing bank on every page.

Thank you so much!

Yes, the July salary is lower because I started on the fifth.

Regarding the 5th of July, do you know if the letter of employment have to be dated after the fifth of January 2021 too, or is it okay if it has been made in the 28 days preceding that (end of December, that is).

In their letter the employer should confirm that the payslips are authentic, your gross annual salary, the length of your employment and the period over which you have been paid the level of salary relied upon in the application and the type of employment (permanent, fixed-term contract or agency).

As such, the letter should be dated after your 6th (December) payslip.

To be clear, if I can get a letter signed on the 17th of December, which is the date I receive my 6th payslip, and applied with it on the 5th of January or afterwards, it's okay?

It's still OK as keeps within the 28 days.
