conversion from Tier2 General main to Skilled worker dependent

Post by priyankaycbo » Wed Dec 15, 2021 2:43 pm

Hi,
I have an query related to conversion from Tier2 General main to Skilled worker dependent.

I've Tier2 general visa as a main applicant and husband along with 2 kids have dependent visa living with me in UK.
I have to go for new extension for Skilled Worker visa.

My husband company is ready to sponsor for him skilled worker visa once my Tier2 general visa is expired. My query is if I convert from Tier2 General to Skilled Worker dependent will I/ my family looses first 3 yrs of Tier2 general visa validity for applying permanent ILR to stay in after 5 yrs ?

Will this start from zero again once my husband gets Skilled worker Main visa?

Thanks,
Priyanka

Yes, all your clocks will reset to zero and a new 5 year period for ilr.

You cannot combine PBS dependent time with main skilled worker/tier 2 time to make up 5 years for ilr.

Thanks for you reply.

I have one more query.

If I staying on my existing visa as a Tier2 Skilled Work visa main applicant for 5 years and later I can apply for ILR along with my kids.

My husband changes from Tier2 General Dependent visa to Tier2 Skilled Work visa main applicant for next 2 years can he apply for an ILR along with me as a spouse?

Thanks,
Priyanka

You can apply. Your children can't as they only qualify for ilr when your husband does. The rules do not permit children to apply for ilr with one parent when the other is not also applying

No! He would need 5 years on his own skilled worker visa before he can apply for ilr.

You cannot combine dependent visa time with main visa time to make up 5 years. This rule applies to both of you, not only you.
