Divorce spouse

Hi,

My friend question:
5 month ago my friend bring her wife as spouse in uk and due to some work/reasons he currently out of Uk and his wife not been contacted more then 1 month( many reason including) and lookalike she cheat on him. he decided to give divorce.He start procedure of divorce in back home where married held.

1- can he cancel her visa?
2- what he has to do now, he need to inform home office as well?
3-or need to do email home office? what email? or any link?
4- he need to report in police?
5- do he need to divorce in Uk court? but he didn't registers married in uk.

1- can he cancel her visa? It is not down to the spouse/sponsor as to whether their visa is cancelled. The Home Office will make this decision.
2- what he has to do now, he need to inform home office as well? It is the responsibility of the your friends and his wife to notify the Home Office of marriage breakdown.
3-or need to do email home office? what email? or any link? They need to write to the Home Office and explain the situation. From reading other forum posts, the address is: UK Visas and Immigration, Marriage Curtailment Team, 7th Floor, The Capital, New Hall Place, Liverpool, L3 9PP.

5- do he need to divorce in Uk court? but he didn't registers married in uk. No. If they were not married in the UK then they would not need to (or be able) to do this.

My friend send letter HO about marriage breakdown.

My friend said:

HER family keep threatening his family and she making fake report in uk to NEW VISA.

What he need to do? he currently in OUT OF COUNTRY.

If your friend has notified the home office of the marriage breakdown, then he has done what he needs to do.

If the threats which you speak of are forcing your friend to assist in sponsoring her through a visa in which he does not consent to or is fraudulent, then I would suggest this is a matter for the Home Office and/or police to intervene with.

If the wife decides to submit an application to switch to another visa (e.g. work, student etc), that is well within her rights to do that and your friend should not seek to interfere with this. Whether or not the visa is granted will be decided by the Home Office.

Though this question is not related to visa or immigration however I will reply based on my cousin experience.

The UK family court have certain rules and regulation for divorce and you to met them to initiate a divorce in UK. So the country your friend is currently their family court must have the similar rule set to follow to initiate a divorce, for example both applicants have to be domiciled in country where divorce is initiated.
As far as finances are concerned in UK a financial settlement is required between parties and it all depends on different factors, one of them is length of marriage and who have invested what in marriage, like a mortgage together. So financial settlement need to be done either family court abroad or in UK. Please consult a family lawyer and they can advise you better.

As far as the visa is concerned you have done the right thing informing Home Office that you not living together anymore, now its all up to Home Office to make decision on visa of your spouse.

Just on immigration side, if and when you marry again you have to submit the divorce certificate (from other county family court) / or UK decree absolute to Home Office confirming your marital status.
