Remain as the mother of a child who was born in UK

Post by samuelchai » Fri Jan 07, 2022 1:57 am

Hi All,

I am a British citizen and my wife is non-British, and she is pregnant.

If she gives birth in the UK, I can apply for British citizenship for my child because I myself am British.

If my wife is on a 6 month visitor visa, is there any way she can apply for leave to remain after giving birth here?

Many thanks for your help.

S

If child is born in the UK to a British parent, then child is automatically British. Child does not need to apply for British citizenship. Just apply for a British passport directly.

Unfortunately, the environmentally unfriendly Immigration Status requirements prevents a visitor from applying under the 5 year partner route, unless there are pandemic concessions.

With a child, she may succeed under the 10-year partner route, subject to exceptional circumstances.

You have been given extensive advice on the process in multiple topics in 2020. In December you were asking about a applying for spouse visa. Why didn't you proceed with the application and do things the right way?
