ILR application 10 years or 5 Years

Post by rakej » Thu Nov 08, 2018 8:18 pm

Dear Senior Members,

Please need your advice on my situation.
Next year in May- 2019 I will complete my 10 years & in the same month, I will complete five years (3 years on Tier-1 entrepreneur & 2 years on Tier-2 General). I also got 2 dependents (Wife & Son born in the UK).

Please, could you suggest which route I should use to apply ILR? I mean 10 years or 5 years?
Also please suggest when my wife & Son will be eligible to apply ILR?

Thanks,

Regards,
rakeJ.

It is your choice which route you choose and meet the requirements of.

However, if you apply for ILR based on long residence, your spouse has to switch to FLR(M) and meet the English and financial requirements. Her clock for ILR based on 5 years residence will also be reset to zero and she will need 2 x 2.5 year visas before she can apply for ILR based on 5 years residence. As you don't state how long she has been in the UK, difficult to advise further.

Your UK born child can be registered as British once you get ILR on either route.

ILR Dependent Visa extension

Post by rakej » Mon Jan 24, 2022 11:32 pm

Dear Senior Members,

Need your help,

I got British citizenship in 2020. My wife is on a dependent visa & her Dependent visa will expire on 26/02/2022.
My wife will complete her 10 years in the UK on 12/08/2022.

If we apply for an extension in Feb then, we have to pay extension fees of £2380 & in August-22, We can apply for her ILR based on 10 years route. But I have to pay again £2380 fees.

Please, could you suggest can we apply for FLR(M) visa so We have to pay less fees ( £1033)?
If yes, then staying under this visa is valid to apply ILR in August-22 based on 10 years route?

Please, suggest if there is any other option so I can save visa fees.
Sorry for asking this question. I have already spent so much money on visa fees.

Thanks.

You were advised on possible paths to take in 2018 as you see above. How did you get ILR ? The 5 years under Tier 2 or the long residence?
Advice is given based on my personal research and experience only. Do NOT contact me via private message for immigration advice

Hi Zimba,

Thank you very much for your reply.
I have applied my ILR on the basis of 10 years residence.
Please, suggest what is the best option to apply my wife's visa?
Thanks,

She has to extend her visa on FLR M. It's a 2.5 year visa and you have to pay 2.5 years IHS plus the visa fee.

All visas count for long residence ILR.
