Applying for partner visa while changing job

Post by rajh1980 » Sat Feb 26, 2022 8:38 pm

Hi everyone

I was granted an indefinite leave to remain residency (5 year tier 2 route) and considering to move to a new job in May 2022. My wife is still in PBS tier 2 dependent visa that expires in Sept 2022.

Will it be okay for her to switch to partner visa in August 2020? I’ll be still in probation period so not sure if she will pass the financial requirement check then.

I’d appreciate your thoughts

She doesn't need to change visa categories. She can simply extend her PBS Dependent for 3 years.

Hi CR001,

Thanks for your quick response. Can she still extend her PBS dependent in spite of my certificate of sponsorship will expire in September 2022?

As I now have Indefinite Leave to Remain and will be changing jobs, I thought our only hope is to switch categories as my future employer doesn't need to issue a CoS for me

Thanks again

Yes she can, the rules permit this.

You've made my day; thank you :D :D

I found the following statement on the Home Office website:
"Your partner and children can apply separately at a later date, for example if they’re not eligible yet. They can continue to extend their visa as your Skilled Worker or T2 dependant, even after you get indefinite leave to remain."

Two quick questions:
1. Does the statement above mean that we only need to give the details of the expired certificate of sponsorship even if I left the employer who sponsored me?

2. My wife will complete two years with the current PBS dependent visa. Will they give her another 3-year visa so that she can apply to ILR under this route in the future?

Thanks again for your help, much appreciated!
