Skilled worker resignation / dependent

Post by Souka87 » Mon Feb 28, 2022 7:48 pm

Hi everyone,
My partner has a skilled worker visa and I have the dependent one.

I am currently working and my partner is thinking about resigning. We would like to know:
1- if I would still be able to work during the 60 days they give after the last day of his work? As it's mentioned online that the 60 days are to leave the country.

2- Could he continue his job search during those 60 days and apply for a visa sponsorship should he find a company willing to sponsor him?

3- If we leave the country within the 60 days, do we have to wait 12 full months before applying for a skilled worker visa? We saw that mentioned in an article about Tier2 visa ( article: weblink removed.

Thank you

1. The 60 days curtailment is from when UKVI sends the curtailment letter. It is NOT from the last date of employment with the sponsor. Only UKVI can cancel a visa.

2. Yes.

3. There is no 12 month cooling off period.

Thank you very much for your prompt reply!
Just to make sure I understand it well, I can still work in that curtailment period, right ?

Thanks again
