What are the immigration options to UK that I have, based on my specific case explained below?

Post by kanchusiddarth » Mon Mar 07, 2022 6:41 pm

I was born in the UK in September 1999. My parents were then on a training visa as doctors in the UK. We moved back to India five years after I was born. Fast forward to now, my dad is working in the UK on a skilled worker visa and holds a permanent residence permit. He is eligible and will be applying for the ILR next year. My mother is working with the NHS too as a dependent on my father's visa. I am 22 years old and am an Indian citizen with an Indian passport. I am not independent yet and currently studying for my Master's in Germany. As my parents have permanently moved to the UK, I would like to move to the UK too or at the least have a way to stay in the UK on the basis of my parent's status without having to return back to India every 6 months (Conditions of the UK visitor visa that I hold). I would appreciate it and be grateful for guidance on this topic.

There is no route for you as an adult based on your parents immigration status.

You would have to find a visa you qualify for in your own right, such as your own skilled worker visa sponsored by an employer.

Birth in the UK itself does not give any advantage to residence in the UK unless (a) one parent acquires ILR (or PR under the EEA Regulations pre-Brexit) before the child's 18th birthday, in which case the child can be registered as a British citizen before their 18th birthday, or (b) the child has been born in and resided in the UK for the first 10 years of their lives, with a strict limit on any absences from the UK, in which case they have a lifelong entitlement to register as a British citizen.

In your case, you have not met either condition and hence you have no advantage over others in immigrating to the UK.

You may want to look at pathways that may lead to settlement in Germany.
