NEED URGENT ADVICE REGARDING MY SPOUSE VISA APPLICATION.

Hi there,

I am an Indian citizen married to a British citizen. I am currently in India going to apply for Spouse Visa and I have a couple of queries...
1. I have not been working since 2020, I was in the Uk visiting my then-fiance and got stuck there due to covid although I left before my visa expired. I came back to India and applied for a marriage visit visa and then got married in the Uk this year and again got stuck there for months due to Covid related travel restrictions. My husband earns well and we have our own house in the Uk and he will be providing all his documents (bank statements, employment certificates, payslips etc.) as well as mortgage, council tax, utility bills etc. Will it be ok since I am unable to show my work-related documents? Although, I will be providing my bank statements that would reflect whatever savings I have got and my master's degree certificate from a Uk university etc.
2. Is it possible that my husband applies for the visa on behalf of me in the Uk and I provide the biometrics in India? Will the process be easier?
3. I am aware of the documents listed in gov.uk for a Spouse visa application. Is there anything extra that I or my husband can provide to make the application foolproof? Thanks a lot!!

2. Is it possible that my husband applies for the visa on behalf of me in the Uk and I provide the biometrics in India? Will the process be easier? It is possible, people do it and does not really make a difference in terms of being easier or not.

Thanks a lot for your reply! Just wondering, if my husband does the application from the Uk, will it cost me less (as mentioned in gov.uk 1,033 GBP if applied within the Uk and 1,523 GBP if applied from outside)? Also, will there be a change in the Immigration health surcharge? Thanks again.

No, an application for a spouse visa can only use the form or applying outside the UK and has a fee if £1523 plus the immigration health surcharge.

The fee of £1033 is for form FLR M spouse visa when the applicant is in the UK applying for a spouse visa extension or switching to a spouse visa from another visa category.

You cannot choose the cheaper fee if you are outside the UK.

No, the fees are for different applications
Initial Spouse visa application is 1,523 GBP - this is applied from outside UK
while spouse visa extension FLRM is 1,033 GBP is an extension or next one after you finish 2.5 years in UK.
The IHS is applicable, no change to it.

Thank you so much for clarifying my doubts. Regarding the Immigration health surcharge, how much do I need to pay exactly? When I use the calculator on gov.uk, it shows for Tier 1 (General Partner) I have to pay 2,184 GBP. But is it for 2.5 years? If so, shouldn't it be 1,560 GBP (considering its 624 GBP per year)?

You are NOT applying for a tier 1 General visa.

You are applying for a spouse settlement visa and the IHS is around £1716

Right. I am sorry I am a little confused. Which Tier exactly does the Spouse visa fall under? I am unable to find anything called a "Spouse visa" on the website. Also, does my husband have to provide his employment paperwork for 6 months from the same employee or is it possible to provide it from different employees (in case he changes jobs)? Thanks again.

Spouse visa does no fall under any "tier", it is it's own visa category.

You can calculate the IHS cost beforehand

Start by selecting "applying alone" as you are applying to join a British citizen.
It calculates as £1.872 (£624pa x 3 for the 2 years 9 months spouse visa).

If he has been with his employer less than 6 months he would have to provide wageslips covering the 12 months prior to the date of application (see Cat. B requirements for further details).

Please also note that the applicaiton fee and IHS fee will be calculated in Indian Rupees or US Dollars and so total amount you pay for the application fee and IHS may be a little more than in fees quoted in GBP.

Hi again, so my husband completes 6 months of his full time job with his current employer on 20th February 2022. I will be applying for the visa after the 20th. He also has been working part time for a year now. I wanted to know if we can provide documents for both his jobs to meet the financial requirements for the spouse visa? Thanks in advance.

If he meets the financial requirements with his full time employment then provide for that job only and apply using CAT A to avoid too much paperwork and likely confusion by CW.

Thanks for the reply. I have another query regarding my husband's bank statements. Within the 6 months statements, there are 2 money transfers in particular(of about £1800 in total) from his own Barclays account to his HSBC account (the one we will use for the visa application). And, there is a transfer of £500 to his friend. Will these transactions be seen as "big deposits" and does he have to provide a bank letter/cover letter explaining the "source of fund" even though its his own money? Will the £500 getting credited needs to be explained as well?

No it is not to pose a problem. Relevance is inflow of his monthly pay to the account corresponding to what is on the payslips.

Hello Everyone! Just wanted to double-check, I have a Master's Degree certificate from a reputed university in the Uk. Will it suffice for the English language proficiency requirement for the visa application? Do I need to mention it anywhere in my cover letter?
Also, my husband doesn't have an "Offer letter" on letterhead from his current employer, he was sent an email offer letter but he is providing his employment letter, wage slips etc. Will this affect the application? Thanks.

We are planning to apply the visas together since we are planning to travel together since it's their first time travelling to the uk. Although they are applying for a very short trip. Should I then mention it somewhere on my cover letter or does it complicate my application in any way?

They are not travelling with you as joined on your application as yours and their pathway of application different I presume.
And applying same or similar times does not mean outcome or decision will be together.
