Non EU Spouse of British citizen.

Post by andreabill » Wed Mar 09, 2022 12:07 pm

Hi all, I'm a British citizen and my wife is Brazilian. She had an EU fam stamp 4 which has now expired. (we forgot when it was due to expire)
What would our next move now be as I'm no longer classed as a European citizen.
Any information would be appreciated.

If you're residing here since 2020, you were supposed to make an application in regards to withdrawal agreement - https://www.irishimmigration.ie/extensi ... awal-agre/
As all IRP cards due to expire on September 2020 onwards are automatically prolonged till March 31st 2022 (so your EUFam should still be valid), I reckon that's the route you should go for.

EUFam card swaps for British nationals' family members were scheduled to finish on 31 December 2021. After that, the EUFam card is no longer an accepted immigration document.

Your wife is lucky that the department have decided to extend the deadline to 30 June 2022. You two have to act now, otherwise your wife's permission will no longer be valid.

Your wife will also need to make an EU3 application - even though you are no longer considered an EU national, you still enjoy most of the EU Treaty rights as long as you have been living in Ireland prior to Brexit.

Thanks for the replies. Do we need to wait for the new card before we apply for the EU3?
