Health Careworker Visa (FKA Tier 2) - Injured at work - Possible Deportation?

Post by secretov » Wed Mar 30, 2022 1:18 pm

My girlfriend of 6 months has come from Zimbabwe to work in the UK. She has been working as a careworker and has passed probation.

She injured herself at work (attacked by a dog) and has now been signed off for 4 weeks by the Fracture Clinic. Her Employer has called her saying that she will be deported if she doesn't come back and do light duties, as her employer has to notify the Home Office if she has more than 10 days off consecutively.

1. Can she be deported?
2. Is this legal?
3. Will she be deported?

She has asked for a copy of her contract but her employer will not give this to her.

Didn't she read and have a copy of contract before starting the job?

Were these 4 weeks on unpaid leave? If yes, the employer is right because only 4 weeks of unpaid leave is allowed each year. But why wasn't she be put on sick leave in the first place? She should be able to take sick leave up to the maximum duration written on the contract.
