Marriage Issues and Home Office informed

Hi

My partner is Indian national and i am British national. He is on Spouse visa leave to remain .His first extension was successful.. We have some serious issues and i informed Home Office that our marriage is not subsisting and send them relevant forms by post.

He still living at same address and our relationship is better now. We never separated and no divorce proceedings were started .I reported to Home Office 3 months ago .He did not receive any curtailment letter or email. His leave will expire in May 2022 and he was originally eligible for ILR after 5 years. I informed him that I have reported Home Office and your ILR will be refused if i am right.

We both wants to live together .How can i withdraw my request from Home Office since his visa was not revoked yet .

Also can i apply for his further extension instead of ILR ?
