I got rejected, please help urgently

Post by s-hasan » Sat Apr 17, 2004 9:19 am

The HSMP Team rejected my application on the basis of not enough salary to qualify for earning salary points. I am currently working for two companies, one as a part-time and one as a full time employee. I sent the pay-slips and experience letters for both, but they didn't even bother to calculate the earnings from my part-time job and just based their decision on the pay-slips for the full-time position (that was not enough to earn the required points). I want to appeal now, has anybody experienced this situation before? and can anyone point me in the right direction on how to appeal and defend my case.

S-hasan,

Is your application incountry or out of country.??

Is your occupation in the 'part-time' job and the 'full time' job related/similar?

Has all the income been declared to the tax authorities?
Where there is a will there is a way.

my Application is from outside UK. My part-time job is related to the full-time occupation. The part-time job is exempted from tax as it is not enough to be taxable.

I am not an expert in these matters. But if your full time job income is
taxable then how is that the income from part time job is not?

What i mean is that the "income" used for calculating income tax is the
"income per individual" and not "income per job per indivudual".

So if your total income (full time + part time) is more than what is the
exemption limit in your country you have pay tax on whatever taxable
income you have.

But then I said I am not an expert. Chess,Kayalami and Cosmopol are
the best candidates to help you.

Cheers.

My part-time income is not taxable as it is from another company, generally it is the responsibility of the comapany to deduct the tax from the salary, as I am not in the taxable limit from my part-time job so there is no tax deducted.

Dear s-hasan,
I cud be mistaken and laws in India could be different but as per the laws here (and i believe everywhere) it is not the duty of the employer alone to deduct and submit taxon your earnings. You also have to declare your earning and submit tax as calculated on total income from multiple jobs and other income streams like stock market, rent from property etc.
