Pbs tier 2 extension dependent husband

Post by Ac1 » Thu Apr 21, 2022 8:34 pm

I came to UK via tier 2 now I have ILR and my daughter now citizenship via MN1 route previously tier 2 dependent visa . My husband has the same tier 2 dependent, it expires this May but he is struggling to pass the life in uk test as he can now do ILR visa. Can he extend his tier 2 dependent another 3 years again? He has extended once already. First time granted then extended can he apply for another the same way? And if so how and which link? Please help

Thanks for your response.
If I apply for my British citizenship does my husband still need to go through these processes such as life in uk tests etc or will be automatically able to get ILR or citizenship?
Just to clarify

Yes, English B1 and LIUK testa are mandatory for ilr which he needs before he can apply for citizenship.

No, nothing is automatic. He needs 5 years residence as a PBS dependent before he can apply for ILR if he meets the requirements.

Once he has ilr and if you are British at that point, then he can apply for citizenship as the spouse if a British citizen if he meets the requirements.

Life in uk test resits

Post by Ac1 » Sat Apr 23, 2022 6:18 pm

My husband passed the life in uk today but the last time he did it was this Thursday and resit today Saturday. The booking online allowed two bookings that close together. I am now seeing something about 7 days via googling does this mean this test is invalid?? Or it should be OK as there is nothing on website and it was the same test centre and name on booking same account. Which link for ILR application from pbs dependent tier 2 Thanks for your help.

Thanks so much so the life in uk test passing 2 days from the last fail shouldn't matter? It was booked on the same account and venue/website

I just realised that his passport expired in Nov 2019 just around when covid started. Will this be a problem for the ILR application? He has an in date BRP all this time but hasn't travelled.

Normally an immigration application requires a valid passport

He has his national Id card from his country that is valid. Will proof of application reference for new passport attached to his application be acceptable? Due to ill health around that time he forgot about renewing it.
My thoughts are just to extend his pbs dependent instead of applying for ILR as I think that ilr application seems to be more strict? Or I could be wrong. Is that the case from your experience?

Sorry to ask another but is there a grace period when you can apply for your next immigration status/visa. Is it that you must apply before or on the date before your curr status expires. Example if expires 2/5/2022 when is the latest to apply without breaking any immigration rules.

All immigration applications require a valid passport. You should apply before visa expiry

So if the BRP says valid until 2/5/2022 the latest to apply for another permit is the 2/5/2022 midnight? Please just need this clarification. He will chance the application with an explanation and hope for the best.

You should apply before midnight, at least a few hours before so that the payment is taken well before that cut off time.
