ILR BRP card expiry and renewal

Hi,

My current ILR BRP card is expiring on 12-Oct-2022, I have travel planned to India for school holidays in July and August and returning on 6th Sep. Am I allowed to enter to UK without any issues, as my BRP will be expiring in 1month. Please clarify.

I am confused because of this line mentioned in the BRP replacement service on this link https://visas-immigration.service.gov.u ... nt-service. Please clarify.

"If your BRP has less than 3 months validity you may want to replace it now if you need to prove your right to work or rent or you are travelling outside the UK."

It's a recommendation.
The issue is not whether you'll have difficulties entering the UK - it's whether you'll be allowed to board the return flight.
You will be allowed to board the return flight as long as it's before the date the BRP expires.
Unfortunately processing times for BRP and most other applications are currently much longer than normal.

If I have entered UK by 6th Sep and submitted application for BRP renewal on 6th Sep and processing time is 8 weeks, am I allowed to stay here in UK after my expiry date 12-Oct-2022 until I receive the new card, when the application I submitted is in progress?. Please clarify.

You have ILR so you can stay as long as you like.
The BRP card is evidence of your status - it is not a visa. If card is expired your ILR is still valid, but an expired card won't be accepted for Right to Work/Rent/Boarding a plane to the UK/etc.

As you have been advised ILR status is permanent and it does NOT expire, only the card does. You may board a plane to the UK as long as your card is valid.

A few points to remember:
- All BRP cards ever issued by the UKVI are only valid until the end of 2024. There is some news that BRPs are being totally phased out in 2024 (possibility replaced by digital proof of status) UKVI so far has not announced the exact plans for post-2024.
- Also note that BRP renewal can take up to 6 months
