Enquiry on tier 2 general PBS dependent

Post by Harry241 » Wed Jun 01, 2022 5:05 pm

Hello everyone, can you please help?

My wife was the primary applicant on tier 2 general work visa, started in June 2017.
I was in the UK at that time on ICT visa as a primary applicant.
But after 5 months, in November 2017 - I switched my visa to Tier 2 dependent visa on my wife. I got my dependent visa until 02-Jul 2012, which is the same date as primary end date.
My wife has got ILR now since it’s been 5 years for her- she got it on 31 May 2022.
Questions-
1) Can I apply for extension on tier 2 general dependent category for another 6 months so I can complete for 5 years on dependent visa to be eligible for ILR? If yes, can you share the online link to apply please?
2) I also tried to find a link to apply- in that I can see there’s few questions which I am not clear upon-
a. Does primary applicant already have their Skilled worker visa? Select Yes or No. So, do I select No as she doesn’t have tier 2 general work visa now?
b. Do you have an application reference number for primary applicant? I believe it is the number for her tier 2 general application and not ILR?
3) How long will I get extension for- Is it 3 years or can I just get for 6 months?
4) I hope home visa doesn’t give me a spouse visa as my wife is on ILR now?

2022?

You'll find the link to the online application here:
https://www.gov.uk/skilled-worker-visa/ ... d-children

You'll be prompted to enter your wife's pre-ILR T2G visa details .

If successful you'll get a mandatory 3 year extension, it is not possible to get a shorter one.

Make sure you don't apply for a spouse visa which would reset your ILR clock to zero

Hi Manic, thanks for your reply.

One last query- there is a question in the application where I need help to answer.

"What time period does primary applicant’s Certificate of Sponsorship (CoS) cover?"
Less than 3 years or more than 3 years are the two options there.

Do I need to select less than 3 years since the COS is about to expire in 1 month?

or shall I select more than 3 years option based on the date COS was issued for 5 years?

Thanks.

Thanks for the prompt response.I have selected that option now.

It's asking me to pay £312 as IHS fee which I paid and now it's asking me to pay £1423 as the application fee.

On gov website it says - If you’re applying from inside the UK to extend, switch or update your visa, the standard fee depends on whether you’ll be in the UK for:
up to 3 years - £719 per person
more than 3 years - £1,423 per person

So does that mean I need to pay £1423 now since mine will be extended for exact 3 years?

Not sure why it didn't ask me to pay IHS for 3 years..seems strange.

Thanks once again, you have been really helpful.

Hi manci,

Do you know why it's not asking me to pay upto 3 years cost i.e £719 ?

Tier 2 Partner Dependent visa query

Post by Harry241 » Thu Jun 09, 2022 2:12 pm

Hi everyone,

Can you please help me on this query as I am about to submit an application.

I am applying for an application to extend by current visa which is tier 2 general partner dependent category as I am falling short of 5 months to be eligible for ILR.

I gather that home visa provides a 3-year extension in this type of case.

1. Can you please advise if home office will charge £719 which is the fees upto 3 years or £1423 which is the fees for more than 3 years?

2. Also, nowhere in the application it’s asking me to provide the length of stay I want to extend, so I assume they will automatically give for 3 years. Is this assumption correct?

3. IHS fees is coming up as £312 which I paid. I was thinking they should charge 3 x £312?

I am making an application from UK itself.

Thanks.

1. Up to 3 years.

2. It will be for 3 years. You cannot choose the length of extension you want.

3. It should be £624 x 3 for a 3 year extension.

Thanks a lot CR001.

On point 1- It's asking me to pay £1423, any idea why would that be?
As we are no able to define the length of extension, so any idea how this cost is being calculated?

Or shall I pay £1423 and attach a covering letter saying you are charging me more and should refund?

Likely you have selected the 'more than 3 years' option.

Depends what option you selected, more than or less than 3 years. You seem to have selected the wrong option, so not really UKVI's fault is it.

That's the question I asked above and manci replied that I should be selecting more than 3 years option. So I am confused now :(

Firstly there is no option for me to choose length of stay.

The only question where it's asking is - "What time period does primary applicant’s Certificate of Sponsorship (CoS) cover?" Less than 3 years or more than 3 years are the two options there. I have selected more than 3 years here which seems to the issue here.

So, do I need to select less than 3 years since the COS is about to expire next month (in 3 week''s time)?

or shall I select more than 3 years option as COS was issued for 5 years from June 2017 until June 2022?

Thanks.

Awesome CR001, I'll select that- and it means I have to refill & resubmit the application now as I have already paid IHS fees and was upto the point of paying application fees. Thanks a lot for your help, really appreciated.

I hope I should be able to reclaim IHS fees but I'll try to figure that out later.

@CR001
The question on the form was: "What time period does primary applicant’s Certificate of Sponsorship (CoS) cover?" As the primary applicant (now on ILR) had a 5 year CoS I suggested to the OP to put the factually correct answer "more than 3 years". The OP will only get a 3 year extension in any case whatever length the primary applicant's CoS was (SW 36.1(b)) and should be charged the corresponding visa fee.
