Claim benefits after ILR?

Post by dewdrops1420 » Wed Jul 13, 2022 7:29 pm

Hi,

I got my ILR BRP in-hand.

Could someone please tell me what all benefits I can apply for?
I already applied for 30 hours childcare and tax free childcare.

Thanks in advance

Has your partner and children all got ILR or British citizenship too?

Everything a British Citizen can apply for, so can you.

Except for a British passport of course.

In your dreams.

Only if the partner and children have settlement too; hence why I asked if they did. And it's clear they have children from their post as they are claiming childcare help!

The keyword here is what "I" can apply for, not what "we" can apply for! So leave the children out of it. 8)

You can't "leave the children" (or the parner) "out of it" because most income based welfare benefits include partners/children. Which is why if these are NRPF, they need to take advice from an immigration advisor. Which is why I asked their immigration status.

There are links on these warnings, on this board alone!!!

Same rules applies to non-British partners of British Citizens. Some Brits can't take some benefits because of the immigration status of their partners.

So that brings us back to where we started from.

Hi,

Thanks for the replies.
I have husband and two kids, they have still not applied.
I'm planning to apply british citizenship for my daughter(born in UK) and hubby and son,ILR non-priority.

What all I can apply with just my ILR?
I would like to get 30hrs childcare from september and tax free childcare to book in holiday clubs this summer.
Is it possible?

Warm regards

Citizens Advice advises to contact an immigrataion advisor when you have a partner and children on LLR. Benefits staff are not immigration experts and you might accidently end up taking Public Funds for those who are NRPF. Scroll down to the two relevant parts (for you) at the bottom of the page (althought the whole page is worth a read).
https://www.citizensadvice.org.uk/immig ... n-control/

Claiming the Council Tax Reduction benefit can also be a problem for a two adult household and one parter LTR. Universal Credit can cause a problem if one partner is NRPF. Have a read of this sticky and all the links in it
claiming-benefits/universal-credit-clai ... 02126.html

Note that for working age parents, Universal Creedit has replaced the 6 low income welfare benefits, Child Tax Credit, Working Tax Credit, Housing Benefit, Income Based JSA, Income Based ESA and Income Support. There are soem still on those old welfare benefits, but they will be moved onto Universal Credit in the next 2 years.

I looked back at your posts and it seems that both of you are skiled workers? Your might be keeping your own children with no need to ask the welfare state for Universal Credit, which also makes both parents work and can impose an up to 3 years sanction.

Child Benefit maybe, if neither of you earn about 60k, but that is one of the benefits Citizens Advice talks about in the link above, when the child is LLR.

I have no idea, sorry. You can either read up on this yourself or ask the immigration advisor your speak to.

I should have added that if you or your husband are one of the following, you can claim Child Benefit.
from Albania, Morocco, San Marino, Tunisia or Turkey and working in the UK
from a country that has an agreement with the UK for Child Benefit

Countries that have an agreement with the UK are:

Barbados
Bosnia and Herzegovina
Canada
the Channel Islands
Israel
Kosovo
Mauritius
Montenegro
New Zealand
North Macedonia
Serbia
