ILR RC expiring

ILR RC expiring

Good part of the day to all!

I got an ILR in 2013, worked in London until 2016, since then been working overseas with a frequent trip back to London (at least once a year, linger during the pandemic).

I am now ready to move back to London with the family. One issue I have is that RC is due to expire next year, 06.2023.

Should I be based in London for extending it?
How long would it take?
Do I need to have a job (permanent or temp) when extending it?

Also, is it better to wait for a new RC to get family visas for the wife and the kids?

Appreciate the responses.

Occasionally travelling here will not maintain ILR status

BRP renewal can only happen in the UK and will take up to 6 months. BRPs are being phased out in 2024, so the max expiry will be the end of 2024. You do not need a new BRP to bring your family here. Assuming your ILR status is vied to not have been lost, then you can apply for a family visa for the family

From that link, it sounds like I am likely to be found to have lost ILR, as I have been away for more than 6 years now (besides frequent visits). In other words, my BRP will not be renewed.

Seems like the best way is to hire an immigration lawyer to figure this out.

If I cannot extend my BRP/Lose my ILR, would I need an employer/sponsor to get a work permit again?

Lawyers cannot do much for you if you fall foul of the rules. I suggest travelling to the UK and then if successful, apply for family

From the rules you posted above, it seems I wont meet the requirements for keeping ILR/extending the BRP, you think it’s still worth a try?

If that doesn’t work, then have to try the Returning Resident route.

I am just looking at contingencies.
