You can apply if you’re in a relationship with someone from the EU, Switzerland, Norway, Iceland or Liechtenstein as their spouse, civil partner or unmarried partner. The relationship must have started by 31 December 2020 and must still exist.
If, however, you were already durable partners before getting married before that date (2+ years of cohabitation AND joint financial responsibilities), then they might be eligible as durable partners.

my salary is more than 28k a year and has some savings as well.
Salary is not relevant for the EU Scheme, it is relevant for the non-EU spousal visa.
