Child born before ILR

Child born before ILR

Hi,

A child was born on 23rd May 22 and the mother got ILR on 07th June 22. Should we apply for British passport for the child or ILR? Whats the procedure, please need help advice. The mother had 5 year refugee status, she's received her ilr after her sons birth.

Should we apply for British passport for the child or ILR?
Only a British citizen can apply for a British passport. The child is not British. Child should be registered as British if UK born on form MN1. Once approved and the registration certificate is received, the a passport can be applied for.

Yes child is born in the UK, in MN1 form it asks for Childs ILR, but the child don't have ILR, the child's mother has ILR.

The form is generic. UK born children are not required to have ILR.

So what should we apply for ? Is it ILR for the child or British Passport?

If child is not automatically a British citizen, then child may not directly apply for a British passport. But a UK born child is entitled to register directly after a parent is granted ILR.
