Earliest date to resign after getting a new BRP with start date in the future

Post by lxy3076 » Thu Aug 18, 2022 11:53 am

Hello,

Situation is that I want to take a break as long as possible between my two jobs and I would like to get the visa decision before I resign.

Let's say in January, I am granted the visa with a new employer with start date in March, can I resign immediately and make my last day in the current job to be in January? Was wondering because in this case, there will be a gap between January and March when I am not on any legitimate visa.

Thanks for the help!

You have a valid visa when your new visa approved. Your current visa will be cancelled when the new one is approved.

There is no rule against an employment gap if that is what you are asking. You need to meet the job start date as mentioned in your CoS and in agreement with your new employer.

Thank you! So can i understand it as as long as I hold a valid visa, although it has a start date in the future, i am still eligible to stay in UK between present and the future start date of the brp?

The new visa start date is usually the date of approval.

You cannot hold two visas simultaneously.
