My mother in law and father in law visitor visa to UK has been refused. Mother in law is unemployed but gets some income from rental cash in hand. Father in law is self employed construction contractor
We submitted income tax returns for both with their application. And on the application form the income declared was same as income tax return. e.g 4.7 lakh INR (approx amount) for both.
We have shown that they both own properties in India and attached title deeds with application.
We also provided our banks statements and sponsor letter showing 25k GBP in savings.
1) can I reapply straight away?
2) What is the best way forward. Do I need to explain why there are large transactions e.g invoices bills? The reason there are large deposit and withdrawal is construction invoices are credited and debited from the joint account. In India most of the transactions are done via cash.
Any advise will be appreciated. Application made from India.
Please see below extract from refusal letter for Mother in Law:
I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) V4.2 to V4.6 of Appendix V: Immigration Rules for Visitors because: You state that you intend to visit the UK for 1 month 14 days to visit your family.
I recognise that family visits are important. I must consider the information regarding your sponsor’s support of your visit separately in my assessment of your application. To consider whether or not I am satisfied that your intentions are as stated and that you meet the requirements of the Immigration Rules I must assess your own personal and financial circumstances.
You state that you are unemployed and are currently earning 472390.00 INR
(£5,012.39 via OANDA.com on 23/08/2022. £1=94.24 INR) per year from investments, which equates to £417.69 per month.
To demonstrate your financial circumstances you have provided a bank statement in your name from xxxxxzz Bank for account number: ****0433, which shows a closing balance of 165876.11 INR (£1,760.06) on 24 May 2022.
Using the month of May 2022 for example, I note that there are large deposits totalling 756300.00 (£8,024.87), which is over 19 times your stated monthly income. I note that large deposits over the reporting period which are not commensurate with you stated earnings, the documents provided do not show where this money has come from, therefore I am not satisfied that these funds are genuinely available to you or that the balance indicated by your bank statement is an accurate reflection of your usual position.
Given all of the above I am therefore not satisfied that you are genuinely seeking entry as a visitor and that you intend to leave the UK at the end of your visit. Your application is therefore refused under paragraph V 4.2 (a) and (c). I am also not satisfied that you have sufficient funds to cover all reasonable costs in relation to your visit without working or accessing public funds. Your application is therefore refused under paragraph V 4.2 (e) of the Immigration Rules.
Refusal letter extract for Father in law:
You state that you are self-employed construction contractor earning 428120.00 INR
(£4,542.65 via OANDA.com on 23/08/2022. £1=94.24 INR) per year, which equates
to £378.55 per month.
To demonstrate your financial circumstances you have provided a bank statement in
your name from xxxxxx Bank for account number: ****3937, which shows a closing
balance of 179678.60 INR (£1,906.52) on 21 May 2022.
Using the month of May 2022 for example, I note that there are large deposits
totalling 692010.00 INR (£7,342.71) which is over 19 times your stated monthly
income. I note that large deposits over the reporting period which are not
commensurate with you stated earnings, the documents provided do not show where
this money has come from, therefore I am not satisfied that these funds are
genuinely available to you or that the balance indicated by your bank statement is an
accurate reflection of your usual position.
