Oh there are many problems associated with applying 1 second after your BRP expires.
You can make a valid out-of-time application within 14 days of becoming an overstayer but you remain an overstayer with no right to work. An out-of-time application does not grant you lawful residence
If you stll have s valid visa, try make an in time application, the complications that may arise with an out of time application is not what you want.
