Apologies if this is in the incorrect place ; but like most people were waiting on an ILR decision, and our current visas have expired while waiting for a decision. We are try to rent a property but the agent we spoke to said that the HO reference number will only tell him that our applications are pending and not that they are approved or not. And he’s under the impression he can’t offer us tenancy because of it? As I understand, as long as our application is pending we have the right to rent? Anyone else know what comfort or details are given to estate agencies when applications are pending? As what he’s saying doesn’t make sense.

Yes. If you validly applied in-time, then your leave is “treated as continuing” under Section 3C, preserving your right to rent, at least until a decision.

Any response for any query takes a long time from the HO, if it comes!

The HO is known for taking their jolly time to respond to anything. Always advisable to put your house in order before expiration of BRP.

In case anyone is in a similar position, apparently landlords receive a code from HO that notifies them a set period we’re allowed to rent. The SLA says 2 days but you never know!

Someone with a pending application with the HO still has the right to rent (time-limited), and lanlords can check this Landlord's guide to right to rent checks.

I understand emergencies can happen but to avoid complicating things the general recommendation is not to change your current status (accommodation/address, civil status, etc.) while having a pending application.
