Dependant visa validity

Post by aitaravi » Mon Sep 05, 2022 10:31 pm

Greetings
Looking for clarification on my daughter's visa validity.
I was on Tier2 ICT category visa and my wife, daughter was on my dependent visas. I obtained ILR in Nov'21 and my wife was granted ILR in Aug'22.
My 14 year old daughter still has the dependent visa and it expires in Mar'23. Now i intend to travel to India with my daughter for important family occasion for 3 weeks duration in Oct/Nov'22 and my queries are
1. Does my daughter's dependent visa still valid ? or does it lapse because i switched over to different visa category ?

Thanks in advance
aita

Did you and your wife get ilr based on 10 years long residence?

Which category dependent visa does your daughter have? PBS Dependent or...?

Thanks CR001 for your reply.
Both myself and my wife obtained ILR via 10 year route.
My daughter's dependant visa was obtained when i was on Tier 2 ICT long term visa in 2020 and valid for 3 years i.e. until Mar'23.
My daughter has spent more than 10 years in UK and i am thinking of applying for British Citizenship in Nov'22 (without ILR route) when i would be eligible as well and together.

Hope my above updates clarifies your query and would be extremely helpful for the clarification around her impending travel to India in Oct/Nov'22 for 3 weeks duration in her current visa circumstances.

Thanks in advance
aita

In that case, her visa is not valid as you or your spouse did not obtain ILR based on the PBS route with 5 years residence.

Also, she needs ILR if she was born abroad before she can apply for citizenship. You should have applied for her ILR when your spouse did.

For ILR based on her 10 years long residence, no issues.

Thank you so much CR001 for your responses.

Please may i kindly request your advise on the following -Mn1 form guidance and please may i be advised if i can use this route for my daughter.

============================================================
https://www.gov.uk/government/publicati ... 1-guidance

Registration at the Home Secretary’s discretion – Section
3(1) application
Children born abroad to parents who are applying for British
citizenship
Where one or both parents are applying for British citizenship they may apply for
one or more children who are not automatically British at birth (see “Automatic
acquisition of British citizenship” above) to be registered as British citizens as part of
a “family application”. Children in this category will be considered at the Home
Secretary’s discretion and will usually be registered only if both the parents are
granted or already hold British citizenship, or if one parent holds British citizenship

Your daughter needs ILR first.

Not sure if you've missed that in CR001's message or you've deliberately decided to ignore it!
No sin in failing, you just have to try and try again!
