Please help - extension not complete five years(under JR)

Post by hsmp2010 » Tue Nov 18, 2008 4:45 pm

Thank God I recently got extension under JR for 3 years. my extension is upto 10 jan 2012 , I entered in UK on 1-mar-07. so I am missing 1 or 2 months. Before I thought and I also mentioned this in cover letter that they will give me extension which will lead me upto five years. I also saw cases where people were granted extra 2 or 3 months. Please help me what should I do ?

They will not give you a 2.2 year visa BUT they could / might give you a 3 year visa.

My friend some says that you have to apply for the 2nd extension again to finally apply for the PR .

3+2+2 === 7 years to get PR

3 YEAR VISA + 1ST EXT 2 YEARS+ 2NS EXT 2YEARS === 7 YEARS

WHAT DOES YOU SAY ABOUT THIS

It does not matter about how long the visas run for, it in the time in country that matters. It is entirely possible to have your figures BUT they do not wait to the end of the 7 year period to apply, they apply at the end of 5 years in the UK.

On the reverse side of the equation you could have back to back to back visas for 10 years and still not make the 5 year residency rule to get ILR!

That means if i get 2 years ext after initial 3 years visa i can apply for PR
RULES ALSO SAYS THAT YOU CANNOT HAVE LEAVE FOR MORE THAN 3 MONTHS IN A YEAR SO THAT MEAN FOR 5 YEARS WE ALLOWED 450 MAXIMUM DAYS LEAVE OUTSIDE UK THAN STILL WE ARE OK TO APPLY FOR PR

You will need to apply for another (HAMP/Tier1)extension before 10-Jan-2012 and then apply for ILR when you complete 5 years in UK (March 2012 onwards).

Unofrunately, you will have to shell out 750 quids for your extension in Jan 2012 before you can apply for ILR in March 2012.

I got reply from HO that send back passport and we will endorse it again up to mar 2012. in JR policy doc it is clearly written that extension should be given enough to take to current threshold of settlement.

Hi Hsmp 2010,

Send back passport to HO and the correct endorsement will be made. Also, include a Cover letter in your application

Cheers.
