confused about wording of decision letter

Post by Anu4real » Wed Aug 31, 2022 5:42 am

the following came with my decision letter

" you submitted an application for limited leave to remain on the basis of being a Spouse of a Settled Person in the UK.
I am wHting to inform you that you have been granted a period of 30 months limited leave to remain on the ten year private life route under Paragraph Gen.3.2. of the Immigration Rules, as we are sadsfied that you meet the requirements of paragraph Gen.3.2. of these Rules. You may be eligible to apply for settlement after completing at least 10 years under this route."

am confused as to under what route i have been granted permission

1) is it private life (i did not apply under this route since i do not qualifty for it )

2) under spouse (my husband is on limited leave to remain )

3) outside the immmigration rules (which is what paragraph Gen 3.2 of the immigration rules is )

What did you apply for as the decision letter clearly stated under what you were granted.
What is yours and husband's immigration history?

Your spouse is NOT a settled person, he has limited leave to remain based on a british child from his previous marriage.

Why are you posting under two usernames? This is strictly not permitted on the forum!! It is unfair to all members who offer advice for free.

Never said My husband was a settled person, i said when we made my first application that was the option we choose , we are confused as to under category I was given, since private life does not apply to me and I can't renewal under the private life category
We don't know if private life route exist for those with exceptional circumstances

My husband posted for over a week and did not get a reply, I figured asking the question in another format might help and not that i wanted to deprived others from getting help
or me taking advantage

My husband is on limited leave to remain as the father of a British child, I was on a student visa when we met and made my first application as the spouse of a settled person (which we now know he is not )
We know that Gen 3.2 of the immigration rules has to do with Exceptional circumstances (outside immigration rules )
But we are confused about the private life part, since I do not qualify under the private life route
We are not sure if we should choose the private life under which route we are applying or choose outside immigration rules

As far as I'm aware your application was granted correctly. When a partner of a migrant with limited leave applies using FLR form (any FLR forms) they will check if you qualify under the rules as a spouse. Since your husband doesn't have settled status yet (I'm assuming he is also on 10 year route) you were granted private life 10 years route to settlement. Hope this helps
