Help on IHSurcharge for Spouse of ILR holder

Hello Experts,

I’m an ILR holder since Jan-2020 and will be applying for my spouse’s visa to join me in the UK next month after our marriage.

Regarding health surcharge, The official site says: “you do not need to pay if you’re applying indefinite leave to enter or remain”

so does this surcharge applies in my case?

Correct. There is no IHS surcharge for the ILR application.

But your spouse is not applying for ILR. They are applying for a spousal visa of 2 years and 9 months, for which an IHS of £1872 would be payable.

This other post would give you an idea of the current charges for a spousal visa from India (based on your profile flag).

Hello Friends,

I am an ILR holder in the UK and my wife will be joining me in the UK, for that she is filling out an application.

We are at the declaration stage of the application and the list of required document seems much less than what I’ve been reading on forums.

Currently, the application shows below required document:
  • Applicant’s passport
  • ECCTIS letter,
  • Degree certificate,
  • TB result,
  • marriage certificate,
  • sponsors (mine) passport copy & ILR BRP
I can provide below documents (from the UK) to support her application however these are not mentioned anywhere in the application:
  • Employment letter,
  • salary slips,
  • rent agreement,
  • bank statement,
  • sponsorship letter ( sample pdf on gov.uk site)
  • council tax,
  • utility bills,
  • wedding photos
Should I add above documents which are available but not required as per the application?

Please advise.

You don't need to start a new thread every time you want to ask a new question. Always continue on this one.

The system isn't perfect. There are mandatory documents to be provided and there are optional documents. Example, you say you meet the wages requirement of £18,600, you have to prove it, not just say it. You say you live in London, you have to prove it. You say you're married, again prove it.

The onus is on you to prove that you meet the requirements for your spouse to be issued a spouse visa.

Read the official guidelines. Go through past threads here. If you do have questions, then you can ask here.

The online system wouldn't itemise every document you have to submit to meet the requirements. I'm afraid it falls on you to prove your relationship beyond reasonable doubt.
No sin in failing, you just have to try and try again!

Thanks Ticktack, I’ve read people from same country have provided different sets of documents for same visa type so thought to check if I’m doing it right.

Makes sense though as proving a relationship is subjective and can be extended to include lots of documents. Better I provide all the documents I have to support her application.

And I’ll remember to continue on same thread instead of starting a new one..
