Dependant of Skilled visa

Hi

My cousin got 3 years skilled worker visa as a Nurse and he is working for NHS .

He has 2 children under 18 in India. His COS letter was issue in July 2022 .He has applied for visa and was granted 3 years skilled visa.His COS letter also certify maintenance (also for dependent) .He did not include family that time. Now he is in the UK for almost 8 months.

Questions:-
1- will his cos letter will be enough to cover dependent maintenance ?

SW 33.2. If the applicant is applying for entry clearance, or has been in the UK for less than 12 months on the date of application, either:
  • (a) funds of at least the amount required in SW 33.3 must be held collectively by one or more of the following:
    • i) the applicant; and
    • ii) the Skilled Worker (P); and
    • iii) if the applicant is applying as a dependent child, their parent who is lawfully present in the UK or being granted entry clearance, or permission to stay, at the same time;
    or
  • (b) the Skilled Worker’s A-rated sponsor must certify that they will, if necessary, maintain and accommodate the dependent partner and/or any dependent child as well as the Skilled Worker, up to the end of the first month of each of their grants of permission, to at least the amounts required in SW 33.3.
If SW 33.2.(b) is true, then yes. Else, no.

Thank you so much Vinny.I got it.

So does it mean CoS for dependants will remain valid until the main applicant leave will expire.

Is the children's mother

* already in the UK with permission?
* if not does she have a visa and intends to travel to the UK with the children?
* or does she intend to remain in India?
