confusion over settlement visa endorsement

Post by netrader » Thu Nov 27, 2008 11:01 am

Hello to all ,
I applied in june for a settlement visa to my unmarried partner in june 2008. I applied on the basis of a relationship of more than four years outside of the uk. We have 2 children aged 9 and 11. I was issued a settlement visa and was told i could apply for ILR as soon as i had passed
the kol test. I was told that as i had already proved co habitation, i would
not have to do the full 2 years and could apply for ILR anytime as long as kol test was completed.
I have just found out that the visa endorsement page of the home office
has been updated and i can no longer find my visa endorsement on the website. My visa endorsement reads
Settlement to join/acc partner[kol req] Hp mor. Thats IT. No code mentioned afterwards. ALL new endorsements seem to have a code ie code 1 etc. Will i still be able to apply right away ? or is my endorsement now obsolete? Lady who answers phone from home office was not very confident of her answer and i dont want to lose my application fee for applying to early. Can anybody confirm if i can still apply right after kol
test is passed? Thanks kindly

13.16 - Entry clearance endorsements wrote:Where an applicant has satisfied all of the requirements for ILE, except the KOL requirement, they should be granted two years leave to enter. During this time they can, at any point, satisfy the KOL requirement and then apply for indefinite leave to remain in the UK. The following endorsement should be used:

D: SETTLEMENT: SPOUSE/CP (KOL REQ): 27 months: Code 1
...
D: SETTLEMENT: TO JOIN/ACC PARTNER (KOL REQ): 27 months: Code 1
where
i.e. "Code 1" just refers to "No recourse to public funds". Its absence shouldn't affect your ability to apply for indefinite leave to remain.
