Replacement BRP

Post by cagla » Sat Dec 31, 2022 10:24 am

Hi;

My husband has ILR statues since 1984. 10 years ago he has got BRP card and it wil expire in one month.
When we were filling application two of the requirements were:

1) Any passport you have held since you have been granted settlement, including expired passports
2) Evidence to prove your continuous residency in the UK since becoming a permanent resident.
39 Original document showing grant of settlement, such as a vignette, passport, or RON 60 letter

It has been 38 years how can we go back an find these document are we misunderstanding something?
WHat should we provide?

Thanks alot in advance

not everyone that reads the thread actually has answers to your questions
for example I see the thread name -> open read it -> understand I don't know the answer -> leave

just wait, you might get an answer soon, maybe later, maybe not at all; it's not on demand service and everyone is unpaid volunteer

Why does he not apply for British citizenship if he has held ILR for so long?

Remember the onus is on rhe applicant to prove they have not lost their ILR status, which is why you are required to submit ebside of residence etc. Likely evidence since his last brp application would suffice.

Also note the brp cards are being phased out next year completely. His new brp card will only be valid till 31st December 2024

Your husband should be able to submit alternative documented evidence such as:
    council tax bills/correspondence
      letter from his employer.
        His current BRP.
          a letter explaining why other evidence is unavailable
          (Casa, not CR001)
          Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

          Thanks a lot;

          He has not lost his ILR status it is only ard replacement (expires 28 Jan) . He has last 10 years council docs, electricity bills Bank Bill etc. He also has a letter from 2013 (after Home office meeting) saying that
          his BRP application is approved. Would these be enough. Actually it is strange Home Office has all
          travel details he has done. Would it be necessary to attach stamps of entry into uk from passports
          for since 2015 (current passport) so they can see that 2 years outside UK not happened.

          Regards

          travel details he has done The onus is on the applicant to prove his residency, they would cross check with their database. Would it be necessary to attach stamps of entry into uk from passports
          for since 2015 (current passport) so they can see that 2 years outside UK not happened. Absolutely, add that to the mix. Very important.
