EC for H1B (US)

Hi All,

For candidates living outside UK,the HSMP guide says the following about EC:

"You will not normally be allowed to submit an application for entry clearance in a country where you are based as a visitor or other temporary basis".

If a person lives(works) in the US, as a H1-B visa holder, does he/she has to come back to Home Country(India) for EC once the HSMP app. is approved?
Does "working on a H1-B visa in the US" makes the person visitor or temporary?

No you will be fine applying from US. On a work visa you are not considered as a visitor.
