Hello all,

Hope all is well. My question is regarding my partner who is a non UK national and she has a child born out of IVF prior to us. I have a new born child born out of this relationship, whom I understand can be registered as a BC, but it is a process in itself.

My question is regarding my unmarried partner and her child. How can i possibly bring them to the UK as I am a British citizen. I was previously married and divorced legally before leaving the UK and my ex wife currently keeps the house with my daughter in that relationship.

I returned to my home country and have been running farm since, so I have no savings £62500 or Job at present. I previously worked in the UK as Engineer and earned around £55k ish before, so I am hoping if I do go back to the UK, I might get something in same region, but sadly will take me time.

As it stands, my partner, my new born son and her child are my priority. What is the best way for me to bring them to the UK all together without me having to go alone, get a job and then try for visa. My partner is Argentine, I understand we can enter UK for 6 months and may be see a solicitor there to help us?

Apologies, I am in dire straits at the moment, so If I had cash or savings, I wouldnt think other means.

You have already been advised about this and that it is a British passport you apply for and not registering the child as British as the child is already British by descent.

Your previous marriage is completely irrelevant and not sure why you keep mentioning this point. You simply need your divorce decree absolute to sponsor a new partner. Anything else to do with your previous marriage is irrelvant.

You need to return to the UK, find a job that meets the minimum income requirement and wait 6 months before you can apply for their dependent visas. There is no magic way around this.

They cannot enter as Visitors and apply for dependent visas within the UK. Not even a solicitor can help you with this and any that say they can, will only be lying to you and taking your money. They charge a lot.

There is no easy way. You can only return, work for 6 months and then sponsor them.

Not for the partner. Visa-free travel means that will enter the UK as a visitor. They can not switch from a visit visa to any other form of visa within the UK.

They will need to make the partner application from any country where they have a non-visit visa (so, some form of either permanent or temporary residency, not a visit visa).

It is possible that you may have to move to the UK alone, get a salaried job earning the earning requirement for at least six months and then start the immigration process for your partner.

Thanks CR001. I have a tough decision to make, but this is an impossible battle i tell you. I will look to move to the UK Solely and see what I can do to bring my family. At present, I am waiting to sell some stuffs, so I can raise money for my flight etc as pesos are worthless at present!

Sorry to repeat the questions I thought there is some loophole, I left the UK in hurry, so I have no Divorce Decree copies etc as all with EX wife. Even my naturalization certificate! I only have British passport and Argentine one.

Sorry one question is, I didnt understand about my son, does he need to be registered as British or I can apply for passport straight away?

Thanks Secret Simon, I Understood now well. So best option is I go alone, get all sorted and may be in one year or less I can have my family over to the UK.

I will look to be back to the UK soon.

Son was born British citizen by descent. You can apply for his British passport directly. You may need your naturalisation certificate for that.

You will almost certainly need your divorce decree absolute certificate to sponsor any spouse or partner to the UK as well.

I think I will have to re apply for Divorce decree and my naturlization certificate once I am back to the UK as I have neither at present. They are both with my ex wife, I regret not picking all my stuffs back then but then it is what it is.

Tough decision but inevitable to separate for awhile so you can make it possible to have your family together with you.
If you go with the visit one, it will be temporary aa she still beed toexit the UK to apply for spouse visa and wait for decision....and the expenses.
