Spouse Visa - Within UK

Hi,

My wife applied for her visa (from within UK) after being made redundant from her job (she was sponsored by them). She had her biometrics appointment 10 weeks ago, got an email 3 weeks ago notifying her of a delay. Issue is she's due to start her new job soon but getting concerned that we have no idea on when this visa will come through.

Anyone know of any issues/delays with the process and anyone we could contact for an update? Tried calling but the answerphone message just says that they are doing all they can.

Feeling a bit stuck.

At this juncture, there's nothing else you can do but to wait. You can't even make any complaints till you've waited for 6 months.
No sin in failing, you just have to try and try again!

Threads on here are replete with reports of delays by applicants though it appears to be speeding up little by little.
Patience is what you will exercise and she still retains the right to work till decision is made on current pending application.
New employer can reach HO to check her right to work but most don't want to go through the hassle. And as prospective employee, we'll she may provide evidence e of having a pending application with HO.

Thank you for you reply. We were under the impression that as she was sponsored by her previous employer that that would not apply in this case and would not be able to work?

We were under the impression that as she was sponsored by her previous employer that that would not apply in this case and would not be able to work?
Your understanding is correct. She is not permitted to work for any other employer until she gets her new spouse visa. At present, she is only allowed to work for the employer who sponsored her Skilled Worker visa. While her pending visa change is being processed, her Skilled Worker visa conditions continue.

Thank you for the clarification. As she was made redundant it looks like the only thing we can don is wait.

Hi everyone, we are still waiting for my wife's visa. We are at week 13 now and our local MP is yet to hear back from Home Office. Getting really worried that her new employer will rescind the job offer. She still can't work anywhere without the visa.

Wondering if cancelling this visa and re-applying for a super priority visa from the UK could be an option or could it be the case that is also delayed? I know its a lot of money but would be worth it to have a job secured.

Thanks for your reply. That is a very good point, I hadn't thought of that. I guess we are literally stuck. She can't go back "home" to work as that will void her application and can't work here at all. She feels like a prisoner and no one is able to give us any form of update.

I couldn't edit my above post so please see an updated reply below:

Thanks for your reply. She was on a Tier 2 sponsored visa but was made redundant so her visa didn't really technically "expire" but I assume that this will be the same. That is a very good point, I hadn't thought of that. I guess we are literally stuck. She can't go back "home" to work as that will void her application and can't work here at all. Offers for priority AFTER an application is submitted are for applications made outside the UK. For applications within the UK, you only get the super priority (5 day priority not available for spouse visas) at the point before paying for the online application. You don't get an offer afterwards and there is no way to change it now.
As I know some people have been offered that for an extra £500.
For applications from abroad yes or within the UK, if available before paying online.
