Earlier Spouse Visa Extension Application

Earlier Spouse Visa Extension Application

Hello Guru and CR001,
I need an advice on the following matter.

My sister in law is on spouse visa and her visa will expires on 25/6/23.

She wants to to apply for her first extension in the first week of April 2023 well before of her 28 days.

Reason is the expecting travel in summer.

Is that fine to apply in April 2023 or she has wait till May 2023.

This depends on when she actually entered the UK. If she entered as soon as she was granted the spouse visa, then she would have been granted 33 months and have an excess of 3 months to play with.
If she entered much later, then the ideal thing to do is to wait till 28 days before expiration.

This would eventually avoid a shortfall of 60 months on a later date.

So in a nutshell, extension can be applied for at anytime, just nice to protect future problems by doing it correctly.
No sin in failing, you just have to try and try again!

Thanks for your quick reply , she came after 15days of her visa grants to the uk.

Following is the timeline

Visa granted period 20-9-2020 - 25-6-2023
Date of grant : 20-09-2020
Date of arrival uk: 02/10/2020
Date of expiry: 25/6/2023

Intended to apply on April 2023.

I believe she is within to apply for her first visa extension , please confirm and advice

Based on the timeframe breakdown, I'd say she can apply in April easily. She has extant leave because she came into the UK almost immediately.

Back in the days, the HO would have sent her an email around April on the 30 months mark ,to ask if further application to remain has been made.
Not sure if that's still common practice.
No sin in failing, you just have to try and try again!

Not sure if that's still common practice. :lol: HO is truggling to deal with current/existing applications with them. :x
