Marriage/Fiance Visa to Spouse visa question

Hi All,

My brother got Marriage visa whilst he was living in UAE, he came to UK and got married couple of weeks ago, i believe he can now apply for Spouse visa within UK.

he is stuck in the application question as below.

Do you currently live together? Yes as they just got married and are living together.
When did you start living together?
They started living together only now as of February 23, but after this question they are asking for items of correspondence for last 2 years for both at least 6 items? how can my brother provide these as he has just arrived in UK and got married?


Can someone please help?

Marriage visa
You need to state exactly which visa as there are two different categories of marriage visa

Marriage visit visa, costs just less than £100, valid for 6 months IR a Fiance visa, costs £1538 and valid for 6 months.

2 years cohabitation evidence is not required if switching from a Fiance visa to a spouse visa on FLR M.

Thanks CR001,

Visa he got Says Marriage CP Standard, not fiance, he can still apply from within UK right?

What needs to be done in his situation for 2 years cohabitation?

Please check how much they paid for the visa as only one of them is eligible to switch to spouse visa within the uk. If it is the wrong visa they have, the spouse visa application will be refused

Ignore the 2 year cohabitation requirement.

Also useful if your brother registers on the forum and asks his own questions please.

Hi CR001,

Application they lodged was *Apply to enter as Partner* and paid around £1500 + but visa vignette says Marriage/CP standard? not fiance visa? and asked for pretty much same documents as you would for spouse visa.

So bit confusing if it is Fiance visa or Marriage visitor? could this be mistake from HO? they wrote marriage instead of Fiance?

It's a Fiance visa, it permits marriage in the uk and switching to a spouse visa.

Forn FLR M is used for all applications. Ignore the cohabitation. UKVI know the rules.

They need the last 6 months payslips, corresponding bank statements, Employment letter, English test, proof of adequate accommodation, passports
