FLR M renewal

Post by aig123 » Wed Mar 08, 2023 6:34 pm

Hello everyone,
I am in the process of renewing my visa on the FLR M , 5 year route.

I earn over the financial requirement of £18,600.

My wife works part time and care for our child and receives carer's allowance which is paid through Universal credit.

Should I tick she does receive this or not.

If I don't, would it affect my application?

Thanks.

Can not recall where it is asked for in the application. If it is then be truthful so far she qualifies to get said Carer's allowance.

Thanks for your reply.

On the Finance stage of the application, after filing the fields for employment, it then asks if partner receives any of these benefits which include Carers Allowance, DLA, PIP, Severe Disablement Allowance etc and the last on the checklist is No, my partner does not receive any of these benefits.

I understand going through this would mean I would be exempt from the financial requirements ( that's if I don't meet it) and adequate maintenance would be used instead.

I am asking because I meet the financial requirements of £18,600 and that if I decide not to include this benefit for the application not to take me through the route of making the application process longer with would now include my wife's income( Letter from employer, payslips, bank statements) added to the final documents to be submitted.

Thanks

Calculating the financial requirement

Unless exempt, the applicant must meet the financial requirement in the form of a minimum income requirement.
The minimum income requirement for a Partner applying under Appendix FM from 9 July 2012 and for a Partner applying under Appendix Armed Forces from 1 December 2013, without dependent children, is £18,600.

Meeting the financial requirement through ‘adequate maintenance’

Where the applicant’s partner is in receipt of any of the following benefits or allowances in the UK, the applicant will be able to meet the financial requirement at that application stage by providing evidence of “adequate maintenance” rather than meeting an income threshold:
• Carer’s Allowance • Disability Living Allowance • Severe Disablement Allowance • Industrial Injuries Disablement Benefit • Attendance Allowance • Personal Independence Payment • Armed Forces Independence Payment or Guaranteed Income Payment under the Armed Forces Compensation Scheme • Constant Attendance Allowance, Mobility Supplement or War Disablement Pension under the War Pensions Scheme • Police Injury Pension

If the applicant’s partner is in receipt of one of the above benefits or allowances on behalf of their child, the applicant will be able to qualify by meeting the financial requirement through ‘adequate maintenance’, with evidence specified in Appendix FM-SE:

What your partner receives or doesn't receive has no effect on your application, if "you" already meet the financial requirement.
That clause is there for those that don't meet the financial requirement, and need to meet it with extra income from the government.
No sin in failing, you just have to try and try again!
