Spouse Route to naturalisation after Set (O)

Post by amanlamba1 » Wed Mar 15, 2023 4:53 pm

Hi,

Couple of questions please:

1. My wife recently received her ILR approval using Set (O) application [not Set (M)]. Since I am a British citizen, I want to submit her citizenship application asap under 3 year route, without waiting for 1 year. Is it possible because ILR was received under Set (O) and not Set (M)?
Another question, is form "AN" same for both 5 year and 3 year route to citizenship?

Thanks,
Aman

Yes, possible, because she's got ILR - the visa route is not relevant.

Another question, is form "AN" same for both 5 year and 3 year route to citizenship? There's only one form - AN!

Thanks,
Aman

Brilliant, many thanks for the quick response.

One more question please. My wife has not used my surname yet, but she now wants it to be added to her name. None of her present documents have my surname. What is the best time to get it added?
1. If before naturalisation; they will ask us to change the name in home country's passport which is difficult.
2. If after naturalisation, is it easy to change name before applying for first British Passport; or we get the first passport, change name and then reapply for the passport.

Thank you very much once again.
Aman

My take on this would be to get the naturalisation done first without trying to add any complications, in her current name.

So the naturalisation certificate would show her name in line with current passport and obtaining British passport first, then do the name change.

Of course, the easiest would be to apply for home country passport with new name - ok, it may be difficult but would mean no complications for naturalisation and British passport at this end. Note that there's no time limit for naturalisation, it's a discretionary application.

Ditto thoughts, many thanks. Seems getting name changed in the UK after being a citizen is straight forward. Really appreciate your responses, Aman.
