Are redundancy payments public funds (Urgent help appreciated)

Post by dudeflying » Tue Mar 21, 2023 2:55 pm

Hello,

Hope everyone is doing well. Urgent general support will be greatly appreciated.

I have ILR and my partner has a spouse visa (5 year route and its financial requirements were met only by my salary during the application process) at the moment. My position is becoming redundant very soon and my company will make redundancy payments.

1) I searched the forum but found conflicting answers in different posts. Are redundancy payments considered public funds for immigration purposes? I could not find it on the list of public funds published by UKVI but I want to know if there is anything I should be careful about.

2) If I receive redundancy payments from my employer, can this affect my ILR status or British citizenship application next year, or my partner's current visa or its extension in 2 years?

Many thanks...

2) If I receive redundancy payments from my employer, can this affect my ILR status or British citizenship application next year, or my partner's current visa or its extension in 2 years? No, however ensure the financial requirements of £18,600(at the moment) is met at least in the last 6months preceeding your spouse's extension application.

Many thanks...

Thank you very much, AmazonianX, for your reply!

So, we are certain that statutory redundancy payments are not public funds for immigration purposes, right?

Also, if I understood correctly, even if the company magically gets funds from the Government to make redundancy payments (I am not sure if this is even possible, I am not an expert on this), this should not make redundancy payment a public fund as it is not listed on the public funds published by UKVI. Is my understanding correct?

Redundancy payments are Not public funds. They are not paid by the government. Your employer pays it.

The word statutory in this sense simply means the minimum payment for redundancies under employment law. It has nothing to do with public funds
