Child Registration-British Father

Good Morning,

I have an urgent query on behalf of my Brother who acquire British passport since 2019 and her daughter born outside the UK and currently holding overseas passport.

He would like to appy for either ILR or a British Nationality for his daughter, but MN1 form guidance is not very much clear as they issue a new version in January 2023. However, both, mother and a child holds dependent visa and their 5 years have been completed last month and now they both are eligible to apply for ILR.

I do understand that his wife needs to apply for ILR first before she go to the route of Naturalisation or so. My question is, does a child need to apply for ILR or she can directly apply for a British Nationality by using MN1 Form, since her father is a British National?

Assuming that the daughter was born abroad before the first parent acquired British citizenship, it is expected
(a) that the child and other parent both have ILR before registering as a British citizen, OR,
(b) that the child have lived in the UK for ten years before registering as a British citizen.
