Child migrating with only one parent on Skilled Worker Visa

Post by Jaknap1234 » Fri May 05, 2023 9:34 am

Hello

I have been offered a job in UK on skilled worker visa, and will start processing. It's a big life change for us as I have 15 years old daughter (going to be 16 in Jul). I have a couple of questions & wondering if anyone has been the same situation or have knowledge about the area

1) My daughter will have the dependant visa, however we are not applying the dependant visa for my husband as he has a stable business in India & do not want to move. Do we need to have both parents on UK visa for child to be migrated as dependant or is it possible for just me & my daughter to come to UK?

2) My daughter is going to be 18 in 2 years time but will get the dependant visa before she turns 16. When she has passed GCSE, we are thinking she will move back to India for University education as I don't think I will be able to afford university education fees in UK (for international student). Would this impact her dependant visa? also would this affect the qualifying period for ILR?

2) For ILR of a dependant child (who is now above 18), does both parent need to be in UK as settled or any other kind of visa?

Thank you SO much in advance for helping me getting the answers to these questions

Both parents need to come, see SW 30.2:
https://www.gov.uk/guidance/immigration ... led-worker
SW 30.2 The applicant’s parents must each be either applying at the same time as the applicant or have permission to be in the UK (other than as a Visitor) unless:
(a) the parent applying for or with entry clearance or permission to stay as a Skilled Worker is the sole surviving parent; or
(b) the parent applying for or with entry clearance or permission to stay as a Skilled Worker has sole responsibility for the child’s upbringing; or
(c) the parent who does not have permission as a Skilled Worker –
(i) is a British citizen or a person who has a right to enter or stay in the UK without restriction; and
(ii) is or will be ordinarily resident in the UK; or
(d) the decision maker is satisfied that there are serious and compelling reasons to grant the child entry clearance or permission to stay with the parent who is applying for or has entry clearance or permission as a Skilled Worker.
