Daily rate pay - spouse visa application

Post by Mazsid » Tue May 16, 2023 2:28 am

Hi All

My husband is applying for a spouse visa from Pakistan. I have a couple of questions in relation to that and wondering if I can get some guidance please.

1. I work for an umbrella company at a fixed day rate. The employment letter I got from my umbrella company states that I am a permanent employee. Is that right?

2. Also, they have calculated the gross annual income which is quite low than what I have earned in the last 6 months. Do I have to show thr gross annual amount on the letter or the day rate? I am still earning more than the threshold. But dont want to confuse the case officer.

3. Can i use a future tenancy agreement? As I am currently living with parents but tenancy is starting from 1st June 2023. Will that be a problem?

Kindly answer these questions as we are applying this week and want to be sure before we go forward. Would br highly grateful x

1. I work for an umbrella company at a fixed day rate. The employment letter I got from my umbrella company states that I am a permanent employee. Is that right? It is OK

2. Also, they have calculated the gross annual income which is quite low than what I have earned in the last 6 months. Do I have to show thr gross annual amount on the letter or the day rate? I am still earning more than the threshold. But dont want to confuse the case officer. If due to company using fixed rate as per contract as again your actual work hours cover letter addressing the variance will clarify this to CW as evidenced by pay slips and account statements. If this is an error in employer letter, get the employer to correct and issue a new one

3. Can i use a future tenancy agreement? As I am currently living with parents but tenancy is starting from 1st June 2023. Will that be a problem?

Thank you for the prompt reply.

Because I work on a per day rate, my salary varies each month depending on the number of days worked in each month. As any bank holidays are unpaid.. also if i take any holidays they are also unpaid.

should my employment letter show the gross annual income?

I am attaching a copy of the emplyment letter here:

To whom it may concern,
Employment Reference: - xxxxx
National Insurance Number: - xxxxx

We can confirm Ms xxxxx is a permanent, full-time employee of xxx and is seconded by us to provide services to third party clients as and when required.

Her employment commenced on xxx and she is currently seconded to our third-party end client xxxxx as a xxxxxx. Her employment agency is xxxxxxxx while she performs services for the end client from her residence.
She works 35 hours a week. Her estimated gross salary is £24,912 per annum.

The information contained in this reference is provided in good faith but on the basis that the Company and any of its employees are under no legal liability in respect of it. It is based on information available to the Company on the date given.

Should you need any further information please do not hesitate to contact us.

Kind regards,
Yours faithfully

The Home Office will take the lowest of your previous 6 months wage amounts and use that figure to calculate your annual income. If the lowest monthly figure multiplied by 12 does not meet the threshold then you will not meet the requirements

Thank you.

Just to recheck:

So this will be classed as a non salaried employment???

In a case where salary varies each month, should I employment letter confirm the annual salary or can they just write the daily pay rate which is £130???

Thanks alottt in advance

It is non salaried employment - using an umbrella company is de facto you claiming to be self employed. That is why umbrella companies are set up the way they are.

I am assuming you do not receive a pay slip but they self bill you to account for the payment you receive?

You can claim to be paid any daily rate you wish but the fact of the matter you do not have a contract of employment that states a minimum annual salary, with X number of days a week worked and/or hours per day worked.

Hey

I do get a proper payslip each month - that indicates my day rate.. number of days worked..total amount earned.. compnay deductions.. my ni deductions, tax and student loan…

But the amount varies each month due to the number of working days each month. Which is also higher than the threshold.. the lowest gross amount earned was in April 2023 which was £2340 - due to the number of bank holidays we had..

With the stated April income bei g your lowest you still exceed the threshold.

Can you please advise if the gross annual income needs
To be mentioned on the letter from the employer?

When showing the calculations, should i just follow the same formula? 6 month payslips added together, theb divided by 6 and into 12 = ???

Is that right? Please answer all questions 😊

DEPENDENTS

Post by Mazsid » Wed May 17, 2023 5:29 pm

Hi all,

Quick questions:

I am British and applying for a spouse visa for my husband in Pakistan.

We have 2 kids, both British and live with me.

On the online form its asking my husband:

Do you have any dependant children?
Include both those travelling with you and those who are not.
(Required)

Yes OR No?

Confused as both the kids are here with me..

Can someone please assist? - Thanks in advance

If they are his children, it is yes. The question is quite clear.

Yes they are our children.

But they are not depending on him as they live with me in UK.

It just confused us..

So the answer to that question would be, yes?

It is a child as a dependent, not 'financial or emotional' dependent!! If the children are your husbands children, it is obvious the answer is YES.

Adequate accomodation question.

Post by Mazsid » Fri May 19, 2023 12:59 pm

Hi team,

Can someone please advise what documents should be sufficient if I am renting a property from a family member?

They have 2 houses and don't live at that property. It's rented at the moment however, my tenancy period begins from 10th June 2023. Will that be a problem?

Thanks in advance

Even though family, so far you are renting, get
Tenancy agreement, no objection letter from landlord.
