FLR(M) application to ILR

Post by AmY_Query_T2_ICT » Thu May 25, 2023 5:18 pm

Hello Everyone,

I need your expertise and experience regarding my case.

I am on Primary Person ILR 08-10-2020 to 31-12-2024

My Wife and daughter 29-01-2012 to 29-07-2023

My wife and daughter will be eligible for ILR 7th Sep 2023; so ideally if I can apply for my wife and daughter 28 days before so it would be 10th Aug 2023.

So I need to clarify if I apply for FLR(M) extension before 29th July 2023 and then how to change/modify/cancel the FLR(M) application extensions so I can apply ILR for my Wife and daughter.

If home office would have given same date as mine 08-10-2020 to 31-12-2024 my wife and daughter would have applied directly for ILR and not required FLR(M) extension.

FLR(M) is not needed. I assume they will complete their qualifying period on 7th Sep 2023. They simply need to apply early on 29-07-2023 but book their appointment for a date which makes them when eligible for ILR (within the 28 days mark), so that it will be 10th Aug 2023 onwards.

Section 3C makes this possible: indefinite-leave-to-remain/dependent-el ... l#p2072912

FLR(M) application to ILR

Post by AmY_Query_T2_ICT » Sat May 27, 2023 9:29 pm

Hello Everyone,

I need your expertise and experience regarding my case.
I am the primary applicant and got ILR valid from 08-10-2020 to 31-12-2024

My Wife and daughter 29-01-2021 to 29-07-2023 applied for FLR(M) as my dependent.

My wife and daughter will be eligible for ILR 7th Sep 2023 (10 Year Route); so ideally if I can apply for my wife and daughter 28 days before so it would be 10th Aug 2023.

So I need to clarify if I apply for FLR(M) extension before 29th July 2023 and then how to change/modify/cancel the FLR(M) application extensions so I can apply ILR for my Wife and daughter.

If the home office would have given the same date as mine 08-10-2020 to 31-12-2024 my wife and daughter would have applied directly for ILR and not required FLR(M) extension.

===========================================================
Primary Applicant on ILR 08-10-2020 to 31-12-2024
Wife and Daughter on FLR(M) 29-01-2021 to 29-07-2023

Wife and Daughter ILR Eligible Date 7th Sep 2023
They can apply 28 days before so it would be 10th Aug 2023.
===========================================================

Now it looks like I need to extend my wife and daughter's FLR(M) application from 29-07-23 to 10-08-2023 just for a few days so I can apply for ILR.

Although they will be eligible for ILR from 10-08-2023 (As per 10 year route)

Yes, but little confused.

I was thinking that as for my wife and daughter, I need to apply for FLR (M) extension before 29th July 2023
[They have valid FLR(M) 29-01-2021 to 29-07-2023]

and then I need to Vary my application from FLR(M) to ILR as they will be eligible for ILR from 10th Aug 2023.

If you can share with me any solicitor so I can consult and process with his help?

a) we can't recommend solicitors here and b) I would say there's no need for a solicitor. It's a common case on this forum, people taking their time to gain extra month or two before getting necessary time.

Confused about what ?? As I explained above you do not need an extension and then vary.
