EEA2 residence card without job from the EU partner

ello . I have a serious problem . please someone help . i am EU citizen and my wife from non EU country . She did an EEA2 application for residence card from 5 March and just today she receive the letter from Liverpool where they ask for my wage slips so that to declare treaty rights.

My wife is working right now and with her salary we can support ourselves. Because of the credit crisis i have not find any job right now and i am still searching for a job .

Does anyone know if they are going to issue the residence stamp or they will say no?????????

Does anyone know any other way if the EU citizen does not work to support the application??????????

I have seriously problem . please help. we have to give the documents the next 20 days.

In order for your wife to get her Residence Card it has to be shown that you are exercising your EU Treaty Rights in the UK. However there are a number of ways for you to exercise your EU Treaty Rights, and being an employed worker is only one of them.

Download this UKBA document, and in particular read from 3. There you will see that it lists the ways to exercise EU Treaty Rights, including Jobseeker. However note that they expect the EU Citizen to find work within 6 months. However you rightly mention the credit crunch and so as long as you can prove that you have been looking for work, that may be OK.

Also Self-sufficient person! As you say "My wife is working right now and with her salary we can support ourselves." and accordingly you are OK under this heading, but a slight potential problem. Under this heading you will see reference to "Comprehensive sickness insurance cover in the United Kingdom", and it is not totally clear that the NHS covers that. See below.

So try to convince them that you are a Jobseeker, and thus exercising your EU Treaty Rights. But they will need proof that you have been seeking work, and continue to do so.

As regards "Comprehensive sickness insurance cover in the United Kingdom" I cannot see that this is confirmed on the UKBA website, but in a rather strange place, the HMRC website ..... on this webpage, it states :-
Comprehensive sickness cover includes the National Heath Service (NHS) cover.
But I think use that as a fallback, and try to show that you are a Jobseeker.
