Home Student Status for dependent son

Post by Scaria1973 » Mon Jun 26, 2023 11:54 am

I and my family came 1 yr ago to the UK. My son is 18 now and will go to uni next year. we will be completing 2 years next year. I like to know when will our son be eligible to take apprenticeship or be eligible for home student fee at uni . will it be only after getting PR or say 3 yrs of stay in the UK. My son is on a dependent visa of his mother who is working on a work permit. Where can we enquire for this issue ? please advise . Thanks [REMOVED]

Name removed to protect OP's privacy. Don't put your name on public forums like that.

Home Student laws vary across parts of the UK; assuming OP is located in England, child needs to hold ILR (or any form of settled status) on the first day of studies to be considered as a home student, unless there's a certain type of leave (which doesn't include OP with work visa).

Generally, individuals must be resident and ‘settled’ in the UK on ‘the first day of the first academic year’ of their course to be eligible for home student status.
[...]
A settled person is someone ordinarily resident in the UK without any immigration restriction on the length of their stay. The regulations take this definition from immigration law (section 33(2A) of the Immigration Act 1971). Students with right of abode in the UK or indefinite leave to remain will meet the criteria.

In England, yes. See category 19 in this guide:

No. The criteria are different than for an apprenticeship. He needs both. In England, Wales or Northern Ireland either he or a parent must have ILR on the first day of the first academic year, usually defined as 1 September, and have been ordinarily resident in the UK for the 3 years before that.
