Urgent Question about ILR qualification

Post by mantony » Sun Jul 02, 2023 9:02 pm

I got my leave to remain in 2015 on a student visa, I changed to the FLRP 10 years route in 2016 and was granted this in 2018. I am married to a British wife who got her citizenship in 2014 and we have two British children and live together. I converted to the FLRM family route 5 years in Dec 2020, I am due to extend the FLRM having completed the first 2.5 years. Although I will qualify for the 10-year-long stay in 2025. I would like to know if I have a shot at applying for ILR now.

Now my question is:

1. Can I apply for indefinite leave to remain after completing the 2/half years under the 5years route?

2. Does 5 years of lawful residence apply to my case since I have got 2/half years on 10 years route before, now another 2/half years on 5 years route?

3. Can I combine the 2/half years on 10 years route together with the 2/half on 5 years route making 5 years altogether to enable me to apply for indefinite leave under the 5 years lawful residence?
Or
4. Do I will still need to complete the 5 years under the 5 years route before I can apply for indefinite?

Please kindly help as I am a bit confused about how the 5 years of lawful residence has been calculated.

Your response will be very appreciated.

Thanks.

You need 5 years on your current visa before you can apply for ilr based on 5 years. You cannot mix different visas and immigration rules for 5 years ilr.

You were advised of this in 2020 when you asked!
