Dependant children of skilled worker visa

Post by Bilalhassan148 » Thu Jul 20, 2023 11:38 am

Hello experts,
I came here as student dependant 2017 and switched my visa to skilled worker in 2019.
I have 2 kids born here. I never applied visa for them because I never intended to travel which I informed in my visa extension when HO asked me if you have child dependants then why are you not applying for them.
HO accepted my no travel reason and granted me and my wife visa.
Because they born here and taking NHS.
My questions are,
My son is going to be 7 next year just before I am eligible for ILR, so should I apply for him first or I should get my ILR first?
Would there be any complications when I apply for my kids either way because they never had visa?
Thanks,

UK born children can be registered as British once either parent is granted ILR.

Note that your children are NOT eligible for free NHS use if they do not and have not held any visas. They were only entitled to 3 months free NHS after birth.

Have you been paying for their NHS use, which is at 150% of cost?

You were already advised of this in March when you asked.

HI,

Thanks for the response.

Can I pay only IHS or do I have to apply visa for them?

If I apply for them once I get the ILR, would there be any complications when it comes to IHS and their stay in UK?

Thanks

Children born in the UK
If you have a child while you’re in the UK, they do not automatically become a British citizen.

You must apply for your child’s dependant visa if you want to travel in and out of the UK with them.

The form you fill in depends on whether your child is inside or outside the UK. Your child must either:

apply online as your child inside the UK

apply online as your child outside the UK

You’ll need to provide a full UK birth certificate for each child, showing the names of both parents.

You must apply for their dependant visa before they turn 18 if they want to stay in the UK.

No you cannot just pay the IHS. It is only payable when a visa is applied for.

Don't know. UK born children have an entitlement to register as British once either parent has ILR.

Can you please shed some light on this? Because this does not force you to apply for dependants unless you want to travel but I am not sure about IHS
