TIER 2 Dates don't correspond with the sponsorship certificate

Post by Nacernotts » Thu Aug 10, 2023 1:24 pm

Hi, could you please help?

In May 2020 I applied for a tier 2 VISA and because of COVID I got it in November 2020, but I started work on 1 July 2020. I got a BRP date issue is 16/11/2020 and the expiry date is 31/12/2024. In my sponsorship certificate, the start date is 1 July 2020 and the end date is 30 June 2025 (5 years). In the letter I received from the home office atlas, it was mentioned permission to stay until 1 July 2025, I emailed the home office, and asked them why on my BRP is only 31/12/2024, and they said "The expiry date on the BRP card is only for the card and not for the period of leave to remain you have been granted". Even if I get the new BRP until 1 Jul 2025, counting from the date of issue of my current BRP (16/11/2020) to 1 July 2025, it won't be 5 years, and it's 4 years 7 months 15 days, and as far as I know, to apply for the ILR it has to be 5 years. Could you please advise what should I do?
Many thanks and I appreciate your help.

You don't need to do anything, every single BRP will expire on 31/12/2024. From that date the immigration status will be digital.

If you still don't qualify for ILR by the expiry date of the current leave (nothing to do with the BRP expiry date) you just need to apply to extend it.

Yes Could you please advise what should I do? Extend to cover remaining days, and if you can delay biometrics appointment for as long as possible then vary to ILR if decision not made by the time you qualify for ILR.
Many thanks and I appreciate your help.
Physical BRP being stopped by last day in 2024 and new electronic means of indicating status to be rolled out.

Thanks for the reply.
Sorry, but I didn't understand what did you mean by delay biometric appointments, could you explain please?

In my sponsorship it was 5 years but because of covid they delayed the issue date (from July to November) which is annoying. And If I have to extend, can I extend for only one year or 6 months? Because I only need 5 months to achieve 5 years, so I can apply for my ILR. Many thanks.

That's related to your biometrics appointment when the time to apply for ILR arrives.

You are still two years away from the qualifying period for ILR under this route, and things can change. Likely you've noticed that the immigration rules are continuously changing.

Whatever is advised now might not be applicable in 2025!

Thanks Lolo2 for the reply.
Under the current circumstances, what's the minimum period I can extend, known that I only need 5 months to achieve 5 years (4 months and 15 days to be exact). Many thanks.
